特朗普致电拉芬斯佩格
2021年1月2日,在长达一个小时的电话会议中,时任美国总统唐纳德·特朗普向佐治亚州州务卿布拉德·拉芬斯佩格施加压力,要求其更改2020年美国总统大选以来该州的选票总数。特朗普在大选中被乔·拜登击败,但特朗普一直不承认选举结果[1],并与其支持者进行了各式各样试图推翻大选结果的运动,例如提出超过80宗法律诉讼、呼吁支持者向国会议员施压、向主持统计选举人团票数的副总统迈克·彭斯施压等。在致电拉芬斯佩格之前,特朗普就已经反复向至少三个他输掉的摇摆州的官员要求重新点算各州的选民投票结果、将部分选民票作废、或将在州选民投票中赢得投票权的民主党选举人替换成支持自己的共和党选举人。拉芬斯佩格在与特朗普通话的翌日将电话录音提交给《华盛顿邮报》报导并获得其他媒体转载[2][3][4]。

在2020年美国总统选举中民主党的候选人乔·拜登击败了寻求连任、代表共和党的唐纳德·特朗普成为第46届美国总统,其中在过往历史上偏共和党的佐治亚州的选民投票中拜登以极为细微的得票比例差(11779票和0.24%之差),赢得这个州的16张选举人团票,成为拜登赢得总统选举的其中一个关键州。特朗普的竞选单位并不承认他落败的摇摆州分的投票结果,并罗列出诸多选举舞弊指控,这些指控都被查证者、选举保安专家和法庭反驳或证伪,而特朗普和他的支持者所提出的所有针对选举的诉讼都没有成功扭转选举结果,这些诉讼案中有一半是法庭不受理,其次是控方主动撤回诉讼[9]。在两位候选人得票非常接近的州分中在第一次点票后,又重新进行了手动点票,最终都是未能改变选举结果[10][11],拜登最终于2020年11月19日获确认赢得佐治亚州[12]。
当2020年11月至12月的选举诉讼案无法取得进展下,特朗普开始对至少密歇根州、宾夕法尼亚州和佐治亚州这些他输掉的州的共和党地方或州官员亲身或透过电话沟通,他向这些州的议员、州检察长和州长施压以求推翻选举结果,包括要求他们重新点票、扔掉部分选票或将代表民主党的选举人团替换为共和党的选举人团[13][14]。
12月5日有报导指特朗普致电了佐治亚州州长布莱恩·肯普,公开要求他和州务卿布拉德·拉芬斯佩格扭转佐治亚州的选举结果,并要挟如果不服从就会作出政治报复[15]。肯普和拉芬斯佩格都是共和党党员,但自从大选的选民投票结束后因为拒绝配合特朗普的舞弊指控,三者关系开始恶化。特朗普于12月30日在推特发文指“肯普应该辞职,这个拒绝承认我们在佐治亚州获得大胜的障碍物。[原文 2][16]”
致电佐治亚州选举调查主任

然而,根据拉芬斯佩格在事发两个月后公布的特朗普与该选举调查主任的通话录音,特朗普并未要求对方找出舞弊行为以及说对方能因此成为“国家英雄”。《华盛顿邮报》于2021年3月11日承认其于1月9日的报导是错误的,并更正了报导的标题和内文[19]。
致电佐治亚州州务卿拉芬斯佩格
[编辑]2021年1月2日,特朗普与佐治亚州州务卿拉芬斯佩格举行了长达1小时的闭门电话会议[3][20]。陪同特朗普一边的有白宫办公厅主任马克·梅多斯、贸易顾问彼得·纳瓦罗、司法部官员约翰·洛特、法律系教授约翰·伊斯特曼和律师鲁迪·朱利安尼、克莱塔·米切尔等人,拉芬斯佩格则由他的法律顾问瑞安·爵曼尼陪同参与对话[21]。翌日1月3日,《华盛顿邮报》和其他主流媒体获得了这次会议的录音[21][22]。
会议内容被公开
[编辑]1月3日,特朗普在录音被媒体公开前发推文指与拉芬斯佩格进行了电话会议,称对方无意或无能力证明选举舞弊[原文 3][23]。拉芬斯佩格指自己本来不打算公开谈论事件,但当看到特朗普的推文对自己进行不实攻击后认为有必要出面澄清,他指1月2日的电话会议是当天临急举行的,因为特朗普在当天早上看到自己在福斯新闻上回应指“大选结果公正和特朗普已经落败”[24]。后来有消息指于1月2日前的一周之间,特朗普有18次尝试过与拉芬斯佩格通电,但基于特朗普和他的团队正在对佐治亚州州务卿和州长提出多项诉讼,拉芬斯佩格决定回避这种会谈[22]。

法律观点
[编辑]有法律专家认为特朗普向州务卿施压的言辞已经触犯了多项选举法例[1],包括州法律和联邦法律中,勾结进行选举舞弊或妨碍选举等罪名[25][26]。选举法专家Edward B. Foley指特朗普的行为是不当和可鄙的,华盛顿公民责任与道德的执行董事称,特朗普意图操纵选举的行为是美国历史上的一个下限,无疑是可以受到弹劾的举动[27]。
《卫报》引述美国宪法教授Richard Pildes指特朗普“有意图目的地要胁州官员败坏选举的廉洁”就已经可能触犯了刑法[28][26][29]。诉讼律师Michael Bromwich指特朗普说“我只想找11780张选票[原文 6]”的这句话可能已经触犯了美国法典第52编[28][30][31]。全国广播公司则报导特朗普这通电话已经足够让调查部门立案研究是否存在利益冲突[32]。
联邦
[编辑]1月4日,民主党的一众领袖以特朗普意图或合谋触犯选举法为由,要求联邦调查局展开调查[33]。尽管有共和党议员认为特朗普只是要求州务卿“寻找合法的选票”,民主党已经就这次事件着手撰写谴责决议书[34],当1月6日首都国会正在为总统选举的选举人团票点票时遭到冲击占领后,以民主党为多数派的众议院以“煽动暴力颠覆国家”为由,对特朗普发起第二次弹劾案,其弹劾草案中引用了这次电话会议指,这是特朗普“为推翻和妨碍认证2020年总统选举结果的事前准备”[35],尽管到参议院的弹劾审判于2月13日无法获得足够共和党参议员支持,让特朗普获判无罪。
佐治亚州
[编辑]佐治亚州富尔顿县地区检察官法尼·威利斯于1月4日发表回应指对这次电话会议内容感到不安,她指民主党的州选举委员会向州办事处的选举分部提出立案调查事件,之后会将案件呈交给州检察长[36],当完成调查后案件便会转交地区检察办公室[36]。2月10日,威利斯向包括拉芬斯佩格和坎普等四位佐治亚州官员发出信件,指她的检察办公室已经正式调查“意图妨碍2020年佐治亚州选举”的相关罪行,并要求官员不要按一般流程销毁相关文件以备作为呈堂证据[37]。
录制和公开会谈的法律责任和权利
[编辑]关于将闭门会议内容录下并公开的行为,有人指州务卿拉芬斯佩格可能要为此面临触犯间谍法的起诉。PolitiFact引述美国保安与宪法法律专家指,特朗普与州务卿的对话不是间谍法涵盖的国防机密信息,再加上录音被流出前特朗普事先在社交媒体透露进行过这次会议[38]。
虽然有谣传特朗普会就私自录下会议内容对拉芬斯佩格提出诉讼,但是进行通话的两端即佐治亚州和首都哥伦比亚特区,其通讯法都允许通讯参与者在不用征求对方同意下单方面录下私人谈话内容[39][40][41],由于这次电话会议来得突然,双方一直没有在订立保密协议下通话[23]。在国会认证总统选举结果前,没有任何一单针对选举的诉讼有提及这次电话会议[42]。
林赛·格雷厄姆致电拉芬斯佩格
[编辑]拉芬斯佩格向媒体透露,正当佐治亚州于2020年11月11日至20日间进行手动重新点票,共和党参议员林赛·格雷厄姆于11月13日私下致电他讨论关于这次重新点票的事宜,其中格雷厄姆问他“如果是发生比较多选票签名错误的县,是否可以取消这些县的所有邮寄选票的资格?[43][44][45]”拉芬斯佩格认为格雷厄姆的意图是要让合法选票作废,但格雷厄姆回应他的目的仅仅是“保护邮寄投票的公正”和确认“邮寄投票如何认证选民签名”,但拉芬斯佩格对这个辩解不敢苟同表示:“我觉得我在这对话中受到威胁[44]。”格雷厄姆又表示他自己作为参议员正在进行选举调查,尽管他当时属于与选举无关的参议院司法委员会[46]。佐治亚州富尔顿县检察办公室于2021年2月13日表示,他们会将格雷厄姆致电拉芬斯佩格一事,与特朗普致电拉芬斯佩格事件同样进行妨碍选举刑法的调查[47]。

特朗普电话录音泄露的第二天,佐治亚州共和党投票系统的项目经理加布里埃尔·斯特林在与拉芬斯佩格的交流中尖锐地反驳了特朗普有关选举舞弊的主张,并具体列举并反驳了特朗普及其盟友宣称有成千上万名青少年、死者和未登记的公民进行了投票,以及特朗普发布的一段误导性的视频,该视频称本次投票中有人伪造了选票,这些伪造的选票是从旅行箱中秘密取回的。斯特林称“总统的法律团队有闭门电话会议的录像,他们也观看了整个录像,所以从我们的角度来看,他们是故意在此方面误导州参议院、选民和美国人民。这是故意而且很明显的[48][49]”。

But these ballots were 100 percent for Biden. And, do you know about that? A very substantial number came in, all for Biden. Does anybody know about it?

Like even you when you went and did that check. And I was surprised because, you know ...the check... And we found a few thousand votes that were against me. I was actually surprised because the way that check was done, all you're doing is you know, recertifying existing votes and, you know, and you were given votes and you just counted them up and you still found 3,000 that were bad. So that was sort of surprising that it came down to three or five I don't know. still a lot of votes. But you have to go back to check from past years with respect to signatures. And if you check with Fulton County, you'll have hundreds of thousands because they dumped ballots into Fulton County and the other county next to it. So what are we going to do here folks? I only need 11,000 votes. Fellas, I need 11,000 votes. Give me a break.
